Negotiate a shorter notice period with your current employer

To shorten your notice period, start by reading the exact notice and buyout clauses in your appointment letter and HR policy, then offer your manager a concrete handover plan with a proposed release date, and only then discuss early release or a buyout. Notice periods in private-sector jobs are set by your contract and company policy, so early release is normally a negotiated favour, and a well-prepared handover is what makes it easy to grant.
This matters most for experienced engineers and analysts, where 60 or 90 day notice periods are common and a new employer may want you sooner.
Read the clause before you say anything
Find these in your appointment letter, offer letter and the HR policy document:
| Question | Where to look | Why it matters |
|---|---|---|
| How many days' notice, and does it differ during probation? | Appointment letter | Sets the default |
| Can notice be bought out, and how is it calculated (basic or gross)? | HR policy, separation section | Sets the cost |
| Can earned leave be adjusted against notice? | Leave policy | Some policies disallow it |
| Who approves early release? | Separation policy | Tells you whose agreement you need |
| Any clawback: joining bonus, relocation, training bond? | Offer letter, bond document | These can be recovered at exit |
Note the exact wording. "Salary in lieu of notice" calculated on basic pay is very different from gross monthly salary.
The buyout arithmetic, with hypothetical figures
Take a hypothetical monthly gross of ₹1,20,000 with basic at ₹60,000, a 90-day notice period, and a policy that allows buyout on basic pay using a 30-day month.
Notice period: 90 days
Days you plan to serve: 45 days
Unserved days: 45 days
Daily rate on basic: 60,000 / 30 = ₹2,000
Buyout on basic: 45 x 2,000 = ₹90,000
Daily rate on gross: 1,20,000 / 30 = ₹4,000
Buyout on gross: 45 x 4,000 = ₹1,80,000The same 45 days costs twice as much under a gross-pay clause. Your policy decides which applies, and it may use actual calendar days rather than 30; check. If a new employer has offered to reimburse a buyout, show them this calculation and get the reimbursement stated in the offer letter or an email from HR before you resign.
Build the handover plan first
A manager's real worry is not the date. It is who will run your work. Write a one-page plan before the conversation.
Handover plan - [Your Name], Data Engineer, Platform team
Proposed last working day: 15 November (45 days from resignation)
Work I own Handover to Done by Status
Nightly sales pipeline (dbt) Rohan 20 Oct Runbook drafted
Finance reconciliation job Rohan 27 Oct Pairing sessions booked
Client X data onboarding Sneha 3 Nov Project two-thirds done; will finish
Monitoring alerts on-call Team rota 10 Nov Swap arranged for my weeks
Documentation: runbooks for each pipeline in the team wiki by 1 Nov.
Knowledge transfer: 6 one-hour sessions, recorded, calendar invites sent.
After release: available for questions by email for 2 weeks. This turns an abstract request into a schedule the manager can check.
The conversation, and the email that follows
Talk to your manager in person or on a call first. Then confirm in writing.
What to say:
I have resigned, and my notice period is 90 days. I have a handover plan that
covers everything I own in about 45 days, and I would like to request release on
15 November if the plan is on track. I am happy to adjust the order of handover
to suit the team. The follow-up email:
Subject: Early release request and handover plan
Hi Anil,
Thank you for discussing my notice period today. As agreed, I have attached my
handover plan. I am requesting release on 15 November, subject to the plan being
completed. If the company requires, I understand the policy allows a buyout of
unserved days on basic pay.
Please let me know if you would like any changes to the plan.
Regards,
[Name]Mentioning the buyout option shows you know the policy without leading with money.
If the answer is no
- Ask what would change it. "If the pipeline handover is done by 1 November, would you reconsider?"
- Ask for a partial reduction. 60 days instead of 90 may be easier to grant.
- Tell your new employer early, with the actual date. Most would rather know than be surprised.
- Do not abandon the job. Leaving without completing notice or an agreed release risks your relieving letter and may lead to a recovery claim. See relieving letter problems.
Things to avoid
- Resigning without having read the clause.
- Saying the new employer "will cancel the offer" unless that is true and they said it in writing.
- Taking unplanned leave during notice to shorten it in practice; it damages the goodwill you need.
If you are still interviewing and have not resigned, the planning in interviewing while serving notice will help you pick the right moment. Frequently asked questions
Can my employer refuse to reduce my notice period?
Usually yes. Your appointment letter and company policy set the notice period, and early release is typically at the company's discretion. That is why the handover plan matters: you are making it easy for your manager to agree, not demanding it.
Who pays a notice period buyout?
It depends on the arrangement. Sometimes you pay your current employer an amount in lieu of the unserved days, recovered from your final settlement, and sometimes the new employer agrees to reimburse it. Get any reimbursement promise from the new employer in writing before you resign.
