The short answer

A notice buyout is the unserved notice days multiplied by a daily rate. The price depends on two choices in your contract or HR policy: whether the rate is based on basic or gross pay, and whether a month counts as 30 days or 365 ÷ 12. Using hypothetical figures, 60 unserved days can cost ₹1,97,260 or ₹5,00,000. If a new employer reimburses the buyout, it is taxable salary to you. Covering ₹5,00,000 after tax in the 30% slab needs about ₹7,26,744.

The hypothetical exit

  • Contractual notice: 90 days.
  • Monthly basic ₹1,00,000; monthly gross ₹2,50,000; annual gross ₹30,00,000.
  • Your manager agrees to release you after 30 days, so 60 days remain.
  • New regime, tax year 2026-27, no other income. The rates are on the Income Tax Department's slab page.

Four daily rates from the same contract

Rate basisDaily rate60 days
Basic ÷ 30₹3,333.33₹2,00,000
Basic × 12 ÷ 365₹3,287.67₹1,97,260
Gross ÷ 30₹8,333.33₹5,00,000
Gross × 12 ÷ 365₹8,219.18₹4,93,151

Switching from basic to gross multiplies the price by 2.5; the day-count convention moves it by only about 1.4%. Look for the words "basic", "gross", "fixed" or "CTC" in the notice clause itself. If the clause says only "salary in lieu of notice", ask HR for the written policy and a worked figure before you commit.

Offsets that shrink the number

Some employers let accrued earned leave count against notice. Others only encash leave in the settlement and refuse to set it off. Suppose 15 days of leave may be adjusted: 45 days remain, and on gross ÷ 30 the buyout falls to ₹3,75,000.

A negotiated release date matters more than any formula. Each week your current manager agrees to waive is 7 days × ₹8,333.33, or ₹58,333, on the gross basis. Handover plans that make an earlier release safe for the team are worth writing before you ask.

    daily = monthly_pay / 30 if month_basis == "30" else monthly_pay * 12 / 365
    return round(daily * days, 2)

def gross_up(net_needed, marginal_rate=0.30, cess=0.04):
    return round(net_needed / (1 - marginal_rate * (1 + cess)), 2)

basic, gross, unserved = 100000, 250000, 60
for label, pay in (("basic", basic), ("gross", gross)):
    for basis in ("30", "365"):
        print(label, basis, buyout(pay, unserved, basis))

print("after 15 leave days:", buyout(gross, unserved - 15))
print("new employer reimburses 5,00,000 net:", gross_up(500000))

What you give up by leaving early

A buyout also ends salary you would otherwise have earned. Serving the full 90 days would earn 60 more days of current gross, or ₹5,00,000 on the gross ÷ 30 basis. If you pay the buyout yourself and the new job starts only on the originally planned date, you lose that salary and pay ₹5,00,000 as well. The trade only works if the new salary starts on the earlier date. Suppose the new gross is ₹3,00,000 a month: 60 earlier days bring in about ₹6,00,000 against the buyout. Compare the two joining dates as a pair of cash flows, not the buyout alone. A different start date may also move a variable-pay record date or a vesting date, so check both documents.

Who pays, and what each route costs you

You pay the old employer. The amount is usually recovered from your full and final settlement, so the settlement may show a negative balance you then pay. Whether the buyout you bear reduces your taxable salary under the 2025 Act is not something we have verified. Do not assume a deduction.

The new employer pays the old one on your behalf. Section 17(1)(f) of the Income-tax Act, 2025_Bill.pdf) treats any sum an employer pays for an obligation the employee would otherwise have paid as a perquisite. On ₹5,00,000, in the 30% slab, that adds ₹1,56,000 of tax (30% plus 4% cess). On a ₹30,00,000 salary your total income stays below ₹50,00,000, so no surcharge arises. At higher incomes, add it.

The new employer pays you a joining bonus sized to cover it. It is the same tax, since a bonus is salary. To be made whole, you need ₹5,00,000 ÷ (1 − 0.312) = ₹7,26,744 of bonus. If the offer says "we will cover your notice buyout", ask whether that means ₹5,00,000 gross or the grossed-up figure. That one question is worth ₹2,26,744.

Sequencing the money

  1. 1Get the buyout amount in writing from your current employer before you resign, or immediately after.
  2. 2Share that written figure with the new employer and agree the gross-up basis.
  3. 3Check whether a reimbursement or bonus carries a clawback. If it does, the arithmetic in joining bonus clawback applies.
  4. 4When the settlement arrives, confirm the recovery matches the agreed days. Auditing a full and final settlement sets out the line-by-line check.

We have not stated the law on whether any notice clause can be enforced, which depends on contract and employment law beyond this arithmetic.

Frequently asked questions

If my new employer pays my buyout, is it taxable?

A sum your new employer pays to discharge an obligation that is yours is a perquisite under section 17(1)(f) of the Income-tax Act, 2025. It is taxed as salary, so the employer should either gross it up or you should budget for the tax.
