Under section 17(1)(h) of the Income-tax Act, 2025, what your employer pays into your recognised PF, NPS and approved superannuation fund is taxable as a perquisite to the extent the combined total exceeds ₹7,50,000 in a tax year. The cap is on the sum of all three, so each can look modest while the total crosses the line. In the hypothetical tax year 2026-27 package below, employer contributions total ₹11,90,000. The ₹4,40,000 above the cap adds ₹1,51,008 of tax at a marginal rate that includes surcharge.
What is counted
| Counted towards the ₹7,50,000 | Not counted |
|---|---|
| Employer contribution to your recognised provident fund | Your own PF contribution |
| Employer contribution to your NPS account under section 124(1) | Your own voluntary NPS |
| Employer contribution to an approved superannuation fund | Gratuity, which is paid on leaving |
The text is in section 17(1)(h) of the Income-tax Act, 2025_Bill.pdf). Section 17(1)(i) then deals with the related annual accretion on the excess contributions. This article does not compute that accretion, because it depends on the fund's returns and on how it is to be calculated, which we have not verified. Ask payroll whether they include it and how.
Case 1: just over the line
All figures are hypothetical. Basic is ₹25,00,000 a year, and your total income before this perquisite is ₹40,00,000, on the new regime.
| Contribution | Annual |
|---|---|
| Employer PF, 12% of full basic | ₹3,00,000 |
| Employer NPS, 14% of basic | ₹3,50,000 |
| Superannuation | ₹1,50,000 |
| Total | ₹8,00,000 |
| Less cap | ₹7,50,000 |
| Taxable perquisite | ₹50,000 |
At ₹40,00,000 you are in the 30% slab, so the ₹50,000 costs 30% plus 4% cess: ₹15,600. Total tax rises from ₹8,11,200 to ₹8,26,800. The rates are on the department's slab page.
Case 2: well over the line
Basic is ₹40,00,000, and total income before the perquisite is ₹70,00,000.
| Contribution | Annual |
|---|---|
| Employer PF, 12% of full basic | ₹4,80,000 |
| Employer NPS, 14% of basic | ₹5,60,000 |
| Superannuation | ₹1,50,000 |
| Total | ₹11,90,000 |
| Taxable perquisite | ₹4,40,000 |
Income is above ₹50,00,000 both before and after adding the perquisite, so the 10% surcharge applies throughout. The marginal rate is 30% × 1.10 × 1.04 = 34.32%. The perquisite costs ₹1,51,008, and total tax moves from ₹19,21,920 to ₹20,72,928.
If the perquisite takes you from below ₹50,00,000 to above it, surcharge starts partway through. That boundary is not modelled here; get the working from payroll or a tax adviser.

Employer PF at 12% of full basic is the key driver. Some employers contribute on the ₹25,000 EPF wage ceiling instead, which is ₹36,000 a year; see EPFO's wage ceiling FAQ. If yours does, Case 2's total falls to ₹7,46,000 and nothing is taxable. EPF on the ceiling or full basic covers that choice.
In both cases here, employer NPS is the largest line. It is also deductible under section 124 on the new regime, up to 14% of basic plus DA. That deduction and the cap are separate provisions. How they interact on your own figures is worth confirming with a tax adviser before you restructure. Employer NPS on the new regime explains the deduction.
Questions to ask before accepting a senior package
- Is employer PF on full basic or the ceiling, and can you choose?
- Is there a superannuation contribution, and is it optional?
- Does payroll already add the excess and the section 17(1)(i) accretion to your TDS estimate?
- If the total exceeds ₹7,50,000, can the excess be paid as cash salary instead, keeping CTC the same?
The last option does not avoid tax, and it gives up the retirement saving the contribution would have built. Cash salary is taxed too, at the same marginal rate. The difference is that it is in your account now rather than locked in a fund.
At this level, reading a package the way a finance team reads it is part of the job. Eligible learners who meet the attendance and capstone criteria get assured job interviews through our hiring network.
Frequently asked questions
Does the cap apply separately to PF and NPS?
No. Section 17(1)(h) adds the employer's contributions to your recognised provident fund, to the NPS scheme under section 124(1) and to an approved superannuation fund together. Only the combined amount above ₹7,50,000 is a perquisite.
Is my own PF contribution counted?
No. The cap is about contributions the employer makes to your account. Your own 12% comes out of your salary and is not part of this total.
